Terms and Conditions

These Terms and Conditions govern your access to and use of the GeoActivity website and the full GeoActivity suite of products and services provided by D'GIS Group. This includes GeoActivity mobile applications, web applications, mapping tools, feeds, data services, support services, content, and related functionality made available through GeoActivity domains, applications, or integrations.

By accessing or using any GeoActivity product or service, you agree to be bound by these Terms and Conditions. If you do not agree, you must not access or use the GeoActivity suite.

You may use GeoActivity only for lawful business or internal operational purposes and only in accordance with these Terms and Conditions. You are responsible for ensuring that all users accessing GeoActivity through your organization are authorized to do so and comply with these terms.

You may not use GeoActivity in a way that could damage, disable, overburden, interfere with, or compromise the security, integrity, availability, or performance of any GeoActivity product, service, network, or dataset.

Certain GeoActivity products or services may require registration, login credentials, license activation, or organization-based access. You are responsible for maintaining the confidentiality of account credentials and for all activity occurring under your account or your organization's access rights.

You must promptly notify GeoActivity or D'GIS Group of any suspected unauthorized access, credential misuse, or security incident involving your account or your use of the GeoActivity suite.

GeoActivity may update, improve, modify, suspend, or discontinue any feature, dataset, workflow, product tier, integration, or service offering at any time. Product availability may vary by platform, geography, subscription level, device compatibility, or third-party dependency.

Coverage maps, rig activity, well information, feeds, and other operational datasets are provided for informational and business-use purposes. Because source systems, third-party inputs, field conditions, and processing times can vary, GeoActivity does not guarantee that all data will be current, complete, or error-free at all times.

Access to some GeoActivity products or services may be subject to separate order forms, subscription plans, invoices, enterprise agreements, reseller arrangements, or platform marketplace terms. Where a separate commercial agreement applies, that agreement will control in the event of a conflict with these Terms and Conditions for the specific purchased services.

Unless otherwise agreed in writing, fees are non-refundable once access has been provisioned or services have been made available, except where required by applicable law.

The GeoActivity website, applications, software, visual design, trademarks, logos, service names, text, graphics, data compilations, and related content are owned by or licensed to D'GIS Group and are protected by applicable intellectual property laws.

Subject to any applicable subscription or service agreement, GeoActivity grants you a limited, non-exclusive, non-transferable, revocable right to access and use the products and services for your internal business purposes. You may not copy, resell, sublicense, redistribute, scrape, reverse engineer, decompile, create derivative works from, or otherwise exploit GeoActivity or its data except as expressly permitted in writing.

You agree not to: (a) use GeoActivity for unlawful, fraudulent, or misleading purposes; (b) interfere with security features or access controls; (c) introduce malware, malicious code, or harmful automated traffic; (d) bypass usage limits or technical restrictions; (e) use bots, harvesting tools, or extraction methods to obtain data beyond authorized use; or (f) remove copyright, trademark, or proprietary notices.

GeoActivity may suspend or restrict access where it reasonably believes use violates these Terms and Conditions, threatens service integrity, or creates legal, operational, or security risk.

GeoActivity products and services may include links to third-party websites, app stores, map providers, or external systems, and may rely on third-party infrastructure, data suppliers, or integrations. GeoActivity is not responsible for the content, availability, terms, privacy practices, or performance of third-party services.

Your use of third-party services is governed by the applicable third-party terms and policies.

If you submit inquiries, support requests, suggestions, product ideas, or operational feedback to GeoActivity, you agree that GeoActivity and D'GIS Group may use that feedback to maintain, improve, and develop products and services without obligation to you, unless otherwise agreed in writing.

Administrative, operational, or service-related notices may be provided through the website, applications, account contacts, or other contact information you provide.

To the maximum extent permitted by law, the GeoActivity website and all GeoActivity products and services are provided on an "as is" and "as available" basis. GeoActivity and D'GIS Group disclaim all warranties, representations, and conditions, whether express, implied, statutory, or collateral, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or uninterrupted access.

You are responsible for verifying information before relying on it in operational, commercial, routing, safety, field, or regulatory contexts.

To the fullest extent permitted by applicable law, GeoActivity and D'GIS Group will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, data, or anticipated savings, arising out of or relating to the use of or inability to use the GeoActivity suite.

To the fullest extent permitted by law, the aggregate liability of GeoActivity and D'GIS Group for any claim arising out of or relating to these Terms and Conditions or the GeoActivity suite will not exceed the amount paid by you or your organization for the applicable product or service during the twelve months preceding the event giving rise to the claim, or CAD $100 if no fees were paid.

You agree to indemnify and hold harmless GeoActivity, D'GIS Group, and their affiliates, directors, officers, employees, contractors, and agents from and against claims, liabilities, damages, losses, and costs arising from your misuse of the GeoActivity suite, your breach of these Terms and Conditions, or your violation of applicable law or third-party rights.

GeoActivity may suspend, restrict, or terminate access to any product, service, account, or dataset at any time where necessary to protect systems, enforce these Terms and Conditions, respond to legal requirements, address non-payment, or mitigate security, compliance, or operational risks.

Upon termination, your right to use affected GeoActivity services will cease immediately, except for any provisions of these Terms and Conditions that by their nature should survive termination.

These Terms and Conditions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles, unless a separate written agreement between you and D'GIS Group states otherwise.

GeoActivity may revise these Terms and Conditions from time to time. Updated versions become effective when posted to this page unless another effective date is stated. Your continued use of the GeoActivity suite after updated terms are posted constitutes acceptance of the revised Terms and Conditions.
